Welcome to PRISM ("the App"), operated by Soterra Labs Limited, Company No. 16618829 ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the PRISM mobile application and related services (collectively, the "Services"). By downloading, installing, or using PRISM, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Purpose of the App

PRISM is designed to enhance productivity and decision-making with regard to pesticide use in the horticultural sector by providing tools, resources, and access to information from multiple sources, including third-party data such as pesticide and crop protection product labels. The App is intended for professional agricultural and horticultural users who understand and comply with applicable UK/international laws and regulations.

PRISM operates within the framework of UK agricultural and food safety legislation, including the UK Plant Protection Products Regulations (retained EU law), the Food and Environment Protection Act 1985, and UK Maximum Residue Levels Regulations.

2. Acceptable Use

You agree to use PRISM only for lawful and professional agricultural or horticultural purposes. You must not:

Use the App in any way that violates applicable agricultural, environmental, or safety regulations.
Rely solely on information provided in the App without verifying it against official product labels or manufacturer documentation.
Input false, misleading, or inaccurate data into the App.
Attempt to reverse-engineer, decompile, or extract the App's risk calculation algorithms or source code.
Scrape, bulk-export, or systematically extract product, MRL, or regulatory reference data from the App.
Attempt to disrupt, damage, or interfere with the App's operation or security.

We reserve the right to suspend or terminate your access if you breach these Terms.

3. Account Registration

Some App features may require creating a user account. You agree to:

Provide accurate and complete information during registration.
Keep your login credentials secure.
Notify us promptly of any unauthorised access to your account.

You are responsible for all activities carried out through your account.

4. Free and Paid Versions

PRISM is available in both free (early access) and premium versions.

The free version includes limited tools and functionality.
The premium version will include full functionality with advanced features and data insights.

We may update available features or pricing with reasonable notice. Continued use after such changes indicates acceptance.

5. Advisory-Only Disclaimer and Risk Calculations

5.1 No Professional Advice

The information within PRISM, including risk assessments, compliance indicators, and product data, is provided for general decision-support purposes only. It does not constitute professional agricultural, scientific, or legal advice.

Users must always consult qualified agronomists or regulatory authorities before making any operational or chemical-use decisions.

5.2 Risk Calculations Are Advisory Only

PRISM calculates risk levels (such as RED, AMBER, and GREEN indicators) using a simplified model based on pre-harvest intervals and safety margins. These calculations are advisory only and do not guarantee regulatory compliance.

The App's risk model does not account for all variables that may affect residue levels or compliance, including but not limited to weather conditions, soil type, rainfastness, tank mixes, application method, or actual residue testing results.

5.3 Overriding Safety Warnings

Where the App presents warnings about product suitability or compliance risks, and you choose to proceed past those warnings, you accept full responsibility for ensuring compliance with all applicable regulations.

Recording a treatment in the App does not constitute legal approval or authorisation to apply that product.

6. Third-Party Information and Data Accuracy

PRISM incorporates data from third-party sources such as pesticide manufacturers, regulatory databases, and public information services, including EPPO codes and regulatory MRL values sourced from public regulatory databases.

While Soterra Labs makes reasonable efforts to ensure accuracy, we do not guarantee the completeness, reliability, or timeliness of such third-party information. Specifically:

Product information, MRL values, pre-harvest intervals, and regulatory data within the App may not reflect the most current regulations or product label amendments.
Soterra Labs will endeavour to keep reference data current but cannot guarantee accuracy at all times.
Users should independently verify all data against current DEFRA, FSA, and HSE publications, as well as the official product label and manufacturer's guidance, before applying any crop protection product.

Product names and trademarks referenced within the App belong to their respective manufacturers.

7. User Responsibility for Compliance

PRISM is a decision-support tool, not a compliance certificate. You are solely responsible for:

Compliance with all applicable UK pesticide regulations, MRL limits, and product label instructions.
Verifying that any product you apply is approved for use on the target crop, in the intended setting, and at the correct dosage.
Ensuring that pre-harvest intervals and other regulatory requirements are met before harvesting or selling produce.

The relevant regulatory frameworks include, but are not limited to:

UK Plant Protection Products Regulations (retained EU law)
Food and Environment Protection Act 1985
UK Maximum Residue Levels Regulations
UK GDPR and Data Protection Act 2018 (for data protection aspects)

8. Disclaimer and Limitation of Liability

To the fullest extent permitted by UK law:

PRISM and its content are provided "as is" and "as available" without any express or implied warranties, including warranties of accuracy, reliability, fitness for a particular purpose, or merchantability.
Soterra Labs makes no warranty that the App will be uninterrupted, error-free, or free from harmful components.
We accept no liability for any loss, damage, or costs resulting from reliance on the App's data, risk calculations, or product recommendations, including but not limited to:
- Crop loss or damage
- Product misapplication
- Environmental harm
- Regulatory fines or penalties
- Lost revenue or reputational harm
- Rejection of produce by retailers or regulatory bodies
Soterra Labs' total aggregate liability to you, to the maximum extent permitted by law, shall not exceed the amount you have paid to us for use of the App in the 12 months preceding the claim.
We accept no liability for service interruptions caused by third-party infrastructure outages (including our database, authentication, or map service providers).

Use of PRISM is entirely at your own risk. Verification against official product labels and current regulatory guidance is mandatory before any agricultural or horticultural use.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.

9. Service Availability

PRISM depends on third-party infrastructure, including cloud database, authentication, and map services. We do not guarantee any specific level of uptime or availability.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable. We accept no liability for any loss arising from service interruptions, whether caused by planned maintenance, technical issues, or third-party outages beyond our control.

10. End-User Licence Agreement (EULA)

10.1 Licence Grant

Soterra Labs grants you a limited, non-exclusive, non-transferable licence to download, install, and use PRISM on your compatible device for personal or professional use, subject to these Terms.

10.2 Licence Restrictions

You must not:

Copy, modify, or distribute the App or its content.
Reverse engineer, decompile, or otherwise attempt to extract the App's source code or risk calculation algorithms.
Scrape, bulk-export, or systematically extract product, MRL, or regulatory reference data.
Use the App for any unlawful or commercial resale purpose.

10.3 Ownership

PRISM and all associated intellectual property rights remain the exclusive property of Soterra Labs. These Terms do not transfer any ownership rights to you.

11. Privacy and Data Protection

Soterra Labs is committed to protecting your privacy and complying with the UK GDPR and Data Protection Act 2018.

11.1 Data Collection and Use

PRISM collects only the data necessary to provide its core functionality: account authentication, crop and treatment records, and risk assessment calculations. We do not collect usage metrics, behavioural analytics, or crash reports.

All user-created data is stored securely on our backend servers. No personal data is sold or shared with external parties.

11.2 Data Security

We use appropriate technical and organisational measures to safeguard user data from unauthorised access, alteration, or disclosure, including encryption in transit, encrypted local storage, and row-level security on our database.

12. User Data Ownership

You retain ownership of all data you create within PRISM, including crop records, treatment logs, location data, and custom MRL values.

By using the App, you grant Soterra Labs a limited licence to store, process, and transmit your data solely for the purpose of providing and maintaining the Service.

On account deletion, all of your data is permanently and immediately deleted from our servers (see our Privacy Policy for full retention details). Soterra Labs may retain anonymised and aggregated data that cannot be linked back to you for the purpose of service improvement and trend analysis.

13. Intellectual Property

All content, software, algorithms, compiled databases, and materials within PRISM — including text, data, graphics, and code — are owned by Soterra Labs or its licensors and protected by UK and international copyright and trademark laws.

Product names, trade names, and trademarks referenced within the App belong to their respective manufacturers and are used for identification purposes only.

Agricultural reference data (such as EPPO codes and regulatory MRL values) is sourced from public regulatory databases and compiled by Soterra Labs. The compilation and presentation of this data within the App is protected by copyright.

You may not reproduce, modify, or reuse any materials without prior written consent.

14. Account Termination

We may suspend or terminate your access to PRISM at any time, with or without notice, if you breach these Terms or misuse the App. Upon termination:

You must cease all use of the App and delete any copies from your devices.
Your data will be retained for 30 days following termination, after which it will be permanently deleted.
No data recovery is possible after deletion.

You may delete your own account at any time from the Settings screen within the App. Self-initiated deletion is immediate and permanent. For more information, visit our Account & Data Requests page.

15. Changes to the App and Terms

We may update PRISM and these Terms periodically. Updates will be reflected in the App and indicated by a revised "Last updated" date.

We also reserve the right to modify product databases, risk calculation algorithms, MRL values, or other reference data at any time to improve accuracy or reflect regulatory changes.

Continued use after any updates constitutes acceptance of the revised Terms.

16. Age Restriction

PRISM is intended for professional horticultural users aged 18 or over. By using the App, you confirm that you are at least 18 years of age.

We do not knowingly provide the Service to individuals under 18. If we discover that a user is under 18, we may terminate their account.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
